Acquisition Management System and FAA ODRA Litigation
Most federal agencies are bound by the Federal Acquisition Regulation, the Federal Aviation Administration (FAA), however, is not. A separate regulation, the Acquisition Management System (AMS), governs FAA procurements.
Likewise, the venue for adjudicating procurement-related disputes is different. Instead of filing a bid protest at the Government Accountability Office, bid protests are handled by FAA’s Office of Dispute Resolution for Acquisition (ODRA). Also, rather than filing a claim with a contracting officer and appealing the decision to a board of contract appeals, ODRA adjudicates all contract claims between FAA and contractors.
We advise FAA contractors on all AMS issues. Similarly, we represent clients (protesters and intervenors) in ODRA bid protests and contract disputes.
